Instructions for Same-sex Marriage Registration

To ensure marriage equality, same-sex partners may apply for same-sex marriage or the termination of same-sex marriage starting May 24, 2019 according to the Enforcement Act of Judicial Yuan Interpretation No. 748.

Criteria for same-sex marriage registration

1. Eligible applicants: both partners must be at least 18 years-old

2. Required documents

A. Marriage application (must be fully completed)

B. Consent form of the legal representative (for underaged applicants)

C. National identification number (or other document verifying the identification of the applicant) and personal seal (or signature) of the applicant

D. Household register

E. Half-body color photo (printed or digital) taken in the past 2 years

F. Fees: NT$50 for renewal of national identification card, and NT$30 for updating the household register

A. Taiwanese citizens may apply for same-sex marriage in Taiwan with foreigners from the following 27 countries that have legalized same-sex marriage, namely Argentina, Australia, Austria, Belgium, Brazil, Canada, Colombia, Demark, Finland, France, Germany, Iceland, Ireland, Luxemburg, Republic of Malta, Mexico (specific regions), the Netherlands, New Zealand, Norway, Portugal, South Africa, Spain, Sweden, the United Kingdom (specific regions), the United States, Uruguay, and Ecuador.

B. Taiwanese citizens who have marriage to a foreigner or another Taiwanese citizen before May 24, 2019 in a foreign country that has legalized same-sex marriage may apply for same-sex marriage in Taiwan using verified marriage certification documents. According to Article 24 of the Enforcement Act of Judicial Yuan Interpretation No. 748 and Articles 46 and 62 of the Act Governing the Choice of Law in Civil Matters Involving Foreign Elements, the date of marriage is based on the date of which the marriage registration is completed at the household registration office.
